TERMS & CONDITIONS OF CONTRACT
1. PAYMENTS - An initial Reservation Fee (deposit) of 50% of the total price is required with the signed contract to hold shooting dates and pre-production video planning. Reservation fees are non-refundable. The remaining balance is due prior to or on your wedding date.
2. RESERVATION OF TIME AND DATE: This contract constitutes an order for one wedding video production. Upon execution of this contract and receipt of the reservation fee, Oxford Media Films will reserve the time and date agreed upon, and will make no other reservations for that time for the duration of the contract. Oxford Media Films may use substitutes or sub-contractors in the fulfillment of all or part of the contracted services. If the payments are not received at Oxford Media Films as specified in this contract, Oxford Media Films has the right to cancel the reservation.
3. DELIVERY OF FINISHED PRODUCT – Upon completion, the final video package will be shipped to the customer postage paid. (Please note that post-production editing can take up to 6-12 weeks depending on the time of year the event takes place) Customer must return draft copies with any requested changes within 30 days of receiving the draft copies.
4. EXCLUSIVE RIGHTS - It is understood Oxford Media Films is the exclusive official videographer retained to perform the services requested on this contract. Display rights: In signing this contract, The customer is acting as agents for all members of the party and guests and grants Oxford Media Films all rights for display, broadcast, exhibition, promotion, and advertising use of all images produced under this contract. All video masters and raw footage remain the exclusive property of Oxford Media Films. 6 months after delivery of your wedding video the raw footage will be bulk erased and is unrecoverable to make space for future events.
5. RESTRICTIONS: The customer is aware that restrictions imposed by others (e.g., photographer, church, reception hall, guests, etc.), and the constraints of the physical environment, safety, weather, and acts of God can affect the quality and extent of video coverage possible. Oxford Media Films cannot guarantee coverage of outside events during inclement weather.
6. POSTPONEMENT/CANCELLATION - Once the reservation fee is received it shall be non-refundable, unless postponement becomes necessary as the direct result of governmental actions or restrictions preventing functions of this nature. In such case, Oxford Media Films shall make reasonable efforts to accommodate a change of the contract date for the event. If Oxford Media Films is unavailable to fulfill its obligations under the terms of the contract for the new date, all monies shall be returned to the client. In the case that the event needs to be canceled for any other reason after the reservation deposit is received, Oxford Media Films shall return any additional payments beyond the reservation fee, made if such cancellation is requested in writing 30 days prior to the date of the scheduled event. If no request for cancellation or postponement is made prior to 30 days of the scheduled event, Oxford Media Films shall be entitled to retain all monies not requested in accordance with the terms of this Cancellation/Postponement Clause, as liquidated damages.
7. STUDIO LIABILITY - Oxford Media Films will take the utmost care with respect to the production, post production and delivery of the video(s). However, in the event Oxford Media Films fails to comply with the terms of this contract, due to any event at or beyond the control of Oxford Media Films, including but not limited to illness, accidents, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Oxford Media Films liability is limited only to refund of all monies received.
8. ADDITIONAL CHARGES - If something occurred at the event that the client does not want to appear in the video, the customer must instruct Oxford Media Films before editing begins. If Oxford Media Films is instructed after the video has been delivered to the client, there will be a charge for re-editing at the current rate of $50 per hour for editing and labor. Unforeseen parking and tolls incurred with traveling to and from the wedding ceremony and reception will be charged to the client.
9. WARRANTIES - Oxford Media Films makes no warranties express or implied, with respect to the work or property that is the subject matter of this contract.
10. PRODUCTION AND EDITORIAL CONTROL - Oxford Media Films is granted full production and editorial control by the customer regarding all aspects of the production and post-production services for this event. In the case a particular segment of the event is either not recorded, partially recorded, or not part of the edited video, it is at the sole discretion of Oxford Media Films as the exclusive producer of the event video recording.
11. MEDIA COMPATIBILITY - Oxford Media Films utilizes flash drives compatible with Smart TV's and computers. Oxford Media Films is not responsible for incompatibility with the flash drive and the customer’s media player. Online versions of the videos are also included with all packages.
12. MEALS - Oxford Media Films asks that a courtesy meal be provided for the videographer(s). Please let us know in advance if a courtesy meal will NOT be provided.
